Compensation: $98 to $122 Hourly

Key Responsibilities

As a Trust & Estate Litigation Attorney, you will:

  • Represent trustees, executors, administrators, beneficiaries, and other interested parties in trust and probate disputes
  • Handle all phases of litigation, including case strategy, discovery, motion practice, mediation, settlement negotiations, trial preparation, and trial
  • Counsel clients on a broad range of trust, estate, and fiduciary matters
  • Represent seniors and their families in financial elder abuse litigation
  • Litigate contested trust and estate matters involving:
  • Lack of capacity
  • Undue influence
  • Fraud and misrepresentation
  • Breach of fiduciary duty
  • Trustee and executor misconduct
  • Asset mismanagement
  • Failure to account or inadequate accountings
  • Trustee removal and surcharge actions
  • Co-trustee and beneficiary disputes
  • Self-dealing and conflicts of interest
  • Conduct and defend depositions, court appearances, mediations, and evidentiary hearings
  • Draft pleadings, motions, petitions, discovery requests, and legal memoranda
  • Develop litigation strategies and provide practical legal guidance to clients
  • Mentor and supervise junior attorneys and legal staff
  • Collaborate with colleagues to achieve successful outcomes for clients



Qualifications:

Qualifications

  • Juris Doctor (J.D.) from an accredited law school
  • Active membership in good standing with the California State Bar
  • Minimum of 6 years of trust and estate litigation experience
  • Strong understanding of California probate, trust, and fiduciary law
  • Exceptional legal research, writing, and analytical skills
  • Demonstrated courtroom, deposition, and mediation experience
  • Excellent negotiation, communication, and client relationship skills
  • Ability to manage complex matters independently while contributing to a team-oriented culture
  • Professional reputation marked by integrity, sound judgment, and collegiality

Preferred Experience

  • Financial elder abuse litigation
  • Conservatorship and guardianship disputes
  • Fiduciary litigation and counseling
  • Trial and evidentiary hearing experience
  • Supervisory or mentorship experience

Work Environment

This position may be based in one of several office locations throughout the Bay Area, with flexibility for hybrid work arrangements. Some travel may be required for court appearances, client meetings, depositions, and business development activities.


Compensation

$98.00-$122.00 Hourly
